Terms of Service

These terms are an agreement between you and TidalAurum LLC ("we", "us"). They cover the Symmi app for iPhone and Android, this website and its free tools, and the Personal Face Report. By using any of them you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Symmi.

Symmi measures facial proportions and symmetry from a photo or a camera scan: it places facial landmarks, computes readings such as angles and ratios, compares them with reference ranges, and on supported iPhones builds a 3D model of your face. The app also offers routines, such as facial exercises and daily habits. The free tools on this website each compute one or a few of these readings in your browser. The Personal Face Report is a paid, made-to-order report with its own report terms, which apply in addition to these.

You must be at least 13 years old to use Symmi. If you are under 18, you need permission from a parent or guardian, who agrees to these terms on your behalf. The app does not require an account.

• Symmi is a wellness and self-care product. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition. Nothing in the app, the tools or a report is medical, dental or psychological advice, or a recommendation for any cosmetic procedure.
• Readings are measurements of a photo. Lighting, camera distance, head angle and expression change them, so they can be inaccurate and can differ between photos. They describe proportions; they are not a judgement of your worth or attractiveness.
• Exercises and routines are general wellness activities. Stop if anything hurts, and talk to a doctor or dentist before starting if you have a medical condition, pain, jaw problems or a recent injury. If your face has changed suddenly, see a doctor.
• Bone structure does not change with exercises or habits, and we don't promise any particular result.
• If using Symmi makes you feel worse about your appearance, please take a break from it and consider talking to someone you trust or a professional.

• The app offers a free first scan. Other features require a paid subscription, bought through the Apple App Store or Google Play and charged to your store account. Prices are shown in the app before you buy and may vary by country.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel your subscription in your App Store or Google Play account settings; deleting the app does not cancel it.
• If a free trial is offered, it converts to a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends.
• Payments and refunds for app subscriptions are handled by Apple or Google under their policies. We don't receive or store your payment card details.
• We may change subscription prices. Apple and Google notify you of a price change as their rules require, and you can cancel before it applies.

The Personal Face Report, when available, is a one-time purchase paid through Stripe. What you get, delivery times and refunds are set out in the report terms.

• You keep all rights to your photos. Use Symmi only with photos of yourself, or of someone who has given you permission.
• In the app and the website tools, your photo is analysed on your device or in your browser and is not uploaded to us.
• If you order a Personal Face Report, you give us a limited permission to process the photos you upload, including through the service providers named in our Privacy Policy, only to make and deliver your report. We don't use your photos for anything else, and we don't sell them.

You agree not to:

• analyse, rate or publish readings of another person's face without their permission, or use Symmi to mock, harass or rank other people;
• upload anything illegal, or photos of anyone under 13;
• copy, resell or commercially use the app, the tools, reports or their results without our written permission;
• reverse engineer the app, scrape the website, overload our services, or get around paywalls or security measures;
• break any law while using Symmi.

We may suspend or end access for anyone who breaks these rules.

The app, the website, the tools, the reports and their design, text, images and software belong to TidalAurum LLC or our licensors, and "Symmi" is our brand. We give you a personal, non-exclusive, non-transferable licence to use them for your own non-commercial purposes under these terms. Your own results are yours to keep and share.

If you downloaded Symmi from the Apple App Store:

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app, its support and any claims about it, including product liability, legal compliance and intellectual property claims.
• Apple has no obligation to provide maintenance or support. If the app fails to meet an applicable warranty, you can notify Apple, which may refund the purchase price; Apple has no other warranty obligation.
• You confirm that you are not in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Your use of the App Store or Google Play is also governed by Apple's or Google's own terms.

Symmi is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Symmi will be accurate, uninterrupted or error-free.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to Symmi is limited to the amount you paid us, or through the app stores for Symmi, in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you, and nothing here limits liability that cannot be limited by law.

If you break these terms or use Symmi to violate someone else's rights, you agree to cover reasonable losses and costs that result for us, to the extent the law allows.

You can stop using Symmi at any time: delete the app and cancel your subscription in your store account. To delete a Personal Face Report account, email us. We may change, suspend or discontinue features, and we may end your access if you break these terms. Sections that by their nature should survive, such as disclaimers and limits of liability, continue to apply.

We may update these terms. We change the date at the top when we do, and for significant changes we will give notice on this page or in the app before they take effect. If you keep using Symmi after a change, the new terms apply; if you don't agree, stop using Symmi.

If you have a problem, please email us first; most issues can be solved that way. These terms are governed by the laws of the United States and of the state in which TidalAurum LLC is organised, without regard to conflict-of-law rules. If you live outside the United States, you keep any consumer protections that the law of your country gives you and that cannot be waived.

These terms, the Privacy Policy and, for the Personal Face Report, the report terms are the whole agreement between you and us about Symmi. If a part of these terms can't be enforced, the rest still applies. Not enforcing a right is not a waiver of it. You may not transfer these terms; we may transfer them as part of a merger, sale or reorganisation.
